Are there special rules for Giftcards issued as part of employee programmes?
Employee Giftcards are special cases for tax and labour law. Their validity follows the general rules under Section 195 of the German Civil Code but may be limited by internal policies. An unreasonably short period would be invalid under Section 307 of the German Civil Code.
When does limitation start for activation cards or Giftcards with a delayed start date?

What happens if a Giftcard provider files for insolvency before the deadline?
Once insolvency proceedings are opened, the Giftcard becomes an insolvency claim under Section 38 of the Insolvency Code. The holder may register the claim in the insolvency table but usually receives only a proportional refund. Redemption after opening is no longer possible.
Can merchants charge processing fees for extended Giftcards?
No. Fees for extending Giftcards are not permitted unless an additional service is provided. Under Section 307 of the German Civil Code, such fees constitute an unreasonable disadvantage. A free goodwill extension is permitted.
How long is a Giftcard valid if it was issued as an advertising gift or promotion?
Promotional Giftcards may have a shorter validity if this is clearly recognisable. A minimum period of six months is generally considered fair. After expiry, there is no legal entitlement to redemption under the principle of good faith.
What applies if a Giftcard is integrated into a bonus or loyalty programme?

What applies if a Giftcard is returned and reissued?
If a Giftcard is cancelled and reissued, the new issue date applies for the start of the limitation period. If there is only a rebooking, the original limitation period continues to apply. Clear documentation is recommended for evidentiary purposes.
What applies to Giftcards that were not activated or used for several years?
If a Giftcard is not activated or redeemed for years, the statutory limitation period still begins at the end of the year of issuance under Section 199 of the German Civil Code. Lack of activation does not alter this unless expressly agreed otherwise.

Can companies shorten validity periods or delete them for data protection reasons?
No. Validity may not be shortened for data protection reasons, as limitation and retention periods are regulated separately. Data may be anonymised under data protection law without affecting the customer’s legal claim.
Do Giftcards bought abroad follow the same limitation rules as in Germany?
No. The applicable national limitation periods apply abroad. For example, Austria provides 30 years, Switzerland 10 years and France 2 years. For online purchases, the law of the merchant’s place of establishment generally applies.
Are there uniform EU-wide rules on the validity of Giftcards?
No. Giftcard validity is regulated at national level. While Germany and Austria generally provide for three years, France for example applies a two year period. The EU plans long term harmonisation within the Consumer Rights framework.
Which rules apply to travel or hotel Giftcards if the service cannot be provided?
If travel or accommodation becomes impossible due to force majeure such as a pandemic or natural disaster, the customer may claim a refund under Section 326 of the German Civil Code. The Giftcard may not simply lapse while performance is objectively impossible.
What obligations do merchants have when they state validity periods on packaging or in an online shop?
Merchants must state validity periods clearly, prominently and truthfully under Section 5a of the Unfair Competition Act. Missing information may be considered misleading. Post purchase changes to validity are not permitted without explicit customer consent.
What happens if a merchant specifies a validity period that is too short?
An unreasonably short validity period, such as less than one year without objective justification, may be invalid under Section 307 of the German Civil Code. In that case, the Giftcard remains valid despite the stated expiry date and consumers may rely on the statutory three year period.
Can merchants limit the validity of Giftcards to less than three years?
Yes, but only if the period is objectively justified and clearly communicated. An excessively short period may be invalid as an unreasonable disadvantage under Section 307 of the German Civil Code. Common practice ranges from one to three years depending on the type of Giftcard.
What obligations do merchants have when extending Giftcards after a customer complaint?
Merchants are not obliged to extend expired Giftcards. A goodwill extension is permissible provided it does not disadvantage other customers. Any extension must not introduce new conditions that worsen the customer’s position under Section 307 of the German Civil Code.
Can the limitation period be contractually extended?
Yes. Merchants may voluntarily grant a longer validity period. A contractual extension beyond the statutory period is permissible and binding under Section 202 of the German Civil Code, whereas shortening is only permitted to a limited extent.
Are there special rules for Giftcards redeemed in instalments or partial amounts?
The limitation period applies to the total value of the Giftcard. If the Giftcard is redeemed in part, the period for the remaining balance continues to run. After expiry, only the remaining amount may lapse, not the amount already used.
Can consumers request a refund after the validity period has expired?
No. As a rule, once the limitation period has expired, the claim for redemption lapses under Section 214 of the German Civil Code. Merchants may offer goodwill solutions voluntarily but are not obliged to do so.
What applies to remaining balances if a Giftcard was partially redeemed?
Partially redeemed Giftcards retain their original limitation period for the remaining balance. After expiry, only the remaining value lapses. Merchants may issue a new Giftcard for the balance but are not required to do so.
Which rules apply to bundle Giftcards or Giftcards with multiple redemption locations?
For collective Giftcards redeemable through partner networks, the limitation period begins with issuance by the original provider. Liability for partners exists only if contractually agreed. Uniform validity periods must be communicated transparently.
Can Giftcards become time-barred if they were issued as donations or charity campaigns?
Yes. Donated Giftcards are also subject to civil law limitation rules under Section 195 of the German Civil Code. For charitable campaigns, organisers may voluntarily grant longer or unlimited validity.
Do experience or event Giftcards have special limitation periods?
Yes, in part. If the Giftcard is linked to a specific service such as a concert, flight or hotel stay, a shorter period may be objectively justified under Section 307 of the German Civil Code. If the event is cancelled, the customer may claim a refund under Section 326 of the German Civil Code.
Are there special limitation rules for online Giftcards sent by email?
No. Online Giftcards are subject to the same limitation rules as physical Giftcards. The decisive factor is the issue date, not the dispatch date. Merchants should nevertheless document verifiably when the Giftcard was created and sent.
Can the limitation period for a Giftcard be interrupted or suspended?
Yes. Under Section 203 of the German Civil Code, the limitation period is suspended while negotiations on the claim are ongoing. Suspension may also result from court action, payment order proceedings or force majeure. After suspension ends, the remaining period continues to run.
Are there special rules for limitation of travel Giftcards issued by the state?
Yes. State supported travel Giftcards issued during the COVID period were subject to special statutory deadlines. In Germany, the temporary voucher scheme under Article 240 Section 6 of the Introductory Act applied, with extended validity until the end of 2023.
What applies if the Giftcard was issued for a brand or branch that no longer exists?
The issuer generally remains obliged to perform under Section 275 of the German Civil Code. If a brand is dissolved or a branch closes, the Giftcard must be redeemed by a successor or refunded. Only in insolvency may the claim lapse.
Which limitation periods apply to Giftcards and prepaid Giftcards?
Giftcards and prepaid cards are subject to the same civil law rules as traditional Giftcards. The limitation period is three years under Section 195 of the German Civil Code. If no expiry date is stated, the statutory rule applies automatically.
What happens legally to expired Giftcards?
After expiry of the agreed or statutory period, the customer’s claim for performance becomes time barred under Section 195 of the German Civil Code. The Giftcard is no longer redeemable and the merchant may refuse acceptance. A voluntary extension remains possible at any time.
Can the validity of a Giftcard be extended retroactively?
